Labor Substitution Elimination and Validity Rule Published May 17, 2007
The Labor substitution elimination and validity rule has been published today in the federal register. Its effective date is July 16, 2007.
This means that labor substitutions can be filed only up to July 13, 2007 (Friday). They will be not be accepted on or after July 16, 2007 (Monday).
Further, for labor certification (LC) applications approved before July 16, 2007, the Immigrant petitions (Form I-140) must be filed with the USCIS within 180 days from July 16, 2007 (by January 11, 2008) and for LC applications approved on or after July 16, 2007, the Immigrant petitions (Form I-140) must be filed with the USCIS within 180 days of approval.
The labor certification (LC) applications will expire if the Immigrant petitions (Form I-140) are not filed accordingly.
